Freedom of Information Act Request APPEAL National Personnel Records Center

(Military Personnel Records)

9700 Page Ave,

St. Louis, MO 63132

Dear FOIA Manager,

This FOIA APPEAL is being submitted due to the fact that four FOIA requests were previously submitted on the same information request, and thus far the response from your office has been unsatisfactory, under the FOIA law.

Previous submissions to your office were dated March 17, 1999, June 17, 1999, September 16, 1999 and March 30, 2000. One of your previous responses indicated that the records being requested "may have been destroyed" in a fire July 12, 1973. In my latest response to that remark in my letter dated March 30, 2000, 1 suggested that the words "may have been" indicates a search of the individuals file was not properly performed. "May have been" indicates to me that the files were not checked.

Thus far the only response from you in reference to my March 30, 2000 request is a standard form dated 4- 1 0-00 indicating you received my request of March 3 0, 2000 on 4- 6-00. (Copy of my March 30, 2000 request and your 4-10-00 response is enclosed)

By this appeal, I am respectfully requesting a thorough search of this individuals records and requested information be done by your office in a timely manner.

Anticipating your response.

Sincerely,

Dennis G. Balthaser
